Current legislation of the online gambling industry in India

The main legislation governing gambling in India is the Public Gambling Act of 1867, a law that prohibits the operation and attendance of public gambling houses. However, this law, which was created long before the internet, does not specifically mention online gambling. Therefore, and due to this omission, the legality of online casinos in the country frequently falls into a gray area, subject to varying interpretations by numerous states.

State variations regarding online casinos

India is made up of states that have the autonomy to regulate gaming within their borders. Thus, this resulted in a mosaic of regulations:

  • Goa e Sikkim: These states are some of the regions that have adopted specific regulations to allow certain forms of gambling, including online casinos. Sikkim, for example, attempted to issue licences to online gaming operators through the Sikkim Online Gaming (Regulation) Act, 2008.
  • Maharashtra: On the other hand, this is a state that follows a more restrictive approach under the Bombay Wager Act.

The challenges of the lack of specific regulation for online casinos in India

The main difficulty in regulating online casinos in India is adapting old laws to the current reality of the internet, which knows no geographical boundaries.  In addition, a lack of accurate legal information can lead to inconsistent application of the law, creating uncertainty for both players and operators.

Recently, there have been many discussions among policymakers about the urgent need for more precise and unified regulation of online gambling. The creation of federal legislation could standardize the rules and provide a more informative and clear legal framework.
